Welcome to polarityair.com. The polarityair.com website (the “Site”) is comprised of various web pages operated by Polarity Air (“Polarity”). polarityair.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your use of polarityair.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.

Our Website

Our website is the central hub where customers can explore the multitude of HVAC and electrical services we provide. It is designed to illustrate our commitment to ensuring everyone enjoys a secure, comfortable living and working environment. We aim to be your reliable partner for all heating, ventilation, air conditioning, and electrical needs.

Our Services

We specialize in a comprehensive range of services, including the installation, maintenance, and repair of heating, cooling, ventilation, and electrical systems. Our proficient team is dedicated to delivering high-quality, customized solutions, promising optimal functionality and longevity for all your HVAC and electrical systems.

Products for Sale

Our online platform also allows customers to purchase high-quality filters essential for maintaining superior air quality and system efficiency. These products are crafted to guarantee that your HVAC and electrical systems run smoothly, ensuring a wholesome and pleasant indoor atmosphere.

Book Appointments & Contact Us

Our website offers a user-friendly experience for customers wishing to book appointments, facilitating a seamless and straightforward process. We prioritize clear and open communication and have established multiple channels through which customers can contact us for inquiries, service requests, or additional information.

Appointments & Cancellations

You can cancel or reschedule a service appointment at no charge with at least 24 hours' notice by calling (972) 379-7563, emailing info@polarityair.com, or replying to your appointment reminder. Appointments cancelled with less than 24 hours' notice, missed appointments, and visits where our technician cannot get access to the equipment may be charged our standard diagnostic fee of $89. We will always try to reach you before a fee applies. If we need to reschedule your appointment, there is no charge to you.

Estimates, Deposits & Installation Cancellations

Estimates are free and are valid for 30 days unless the estimate says otherwise. Installations and new systems may require a deposit when you sign your agreement.

Your three-day right to cancel. When you sign an agreement for work in your home, you may cancel it without penalty until midnight of the third business day after the day you signed, as provided by Texas law (Texas Business & Commerce Code, Chapter 601). To cancel, call (972) 379-7563 or email info@polarityair.com, or send written notice to our office. We will refund any deposit or payment in full within 10 days of receiving your notice. If you ask us to begin emergency work right away and waive this right in writing, as Texas law allows, the three-day period does not apply to that work.

After three business days. You may still cancel before installation is complete. We will refund your deposit minus the cost of any special-order equipment or materials already purchased for your job that cannot be returned to the supplier, any restocking fees charged to us, and the value of any work already performed. We will give you an itemized statement of any amount we keep.

Refund Policy

• Diagnostic and service call fees are earned once the diagnostic visit is completed and are not refundable.
• Repairs and installations are covered by the written warranty you receive with your invoice. If something we repaired or installed is not working as it should, contact us and we will inspect it and correct any workmanship or covered part at no charge under that warranty. Refunds for completed work are not otherwise available.
• Overpayments and billing errors are refunded in full once confirmed.
• How refunds are paid. Approved refunds are issued to the original payment method within 10 business days. If your purchase was financed through a third-party lender, the refund is sent to the lender and is handled under your financing agreement.

POLARCLUB Memberships

POLARCLUB memberships renew automatically each year unless you cancel at least 30 days before your renewal date. If you cancel within the first three months, a fee equal to the member discounts you received applies. Memberships can be transferred to a new homeowner in our service area. Membership fees are billed monthly or annually in advance and are not refundable for the current billing period once a member visit or discount has been used. Your membership agreement contains the full terms and exclusions.

Dispute Resolution

If you are unhappy with our work or with a charge, please contact us first at (972) 379-7563 or info@polarityair.com. Most concerns can be settled with a phone call, and we will respond within two business days. If a concern is not resolved, send us a written description of the issue and the outcome you want, and we will both work in good faith for 30 days to resolve it.

If we cannot resolve it in that time, either of us may bring an individual claim in a small claims (justice) court or in the state courts located in Collin County, Texas. These Terms and any dispute between you and Polarity Air are governed by the laws of the State of Texas. If you dispute a card charge with your bank before contacting us, we may not be able to help you as quickly, so please reach out to us first. Nothing in this section limits any right you have under Texas consumer protection law.

Engagement & Information

In addition to being a gateway to our services and products, our website serves as a resource for information, tips, and updates on HVAC and electrical systems and indoor air quality. We strive to share our knowledge and insight to help our customers make well-informed decisions about their heating, cooling, and electrical needs.

Electronic Communications

Visiting polarityair.com or sending emails to Polarity constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

Children Under Thirteen

Polarity does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use polarityair.com only with permission of a parent or guardian.

Links to Third Party Sites/Third Party Services

polarityair.com may contain links to other websites (“Linked Sites”). The Linked Sites are not under the control of Polarity and Polarity is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Polarity is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Polarity of the site or any association with its operators. Certain services made available via polarityair.com are delivered by third party sites and organizations. By using any product, service or functionality originating from the polarityair.com domain, you hereby acknowledge and consent that Polarity may share such information and data with any third party with whom Polarity has a contractual relationship to provide the requested product, service or functionality on behalf of polarityair.com users and customers.

No Unlawful or Prohibited Use/Intellectual Property

You are granted a non-exclusive, non-transferable, revocable license to access and use polarityair.com strictly in accordance with these terms of use. As a condition of your use of the Site, you warrant to Polarity that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.

All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of Polarity or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.

You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. Polarity content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of Polarity and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of Polarity or our licensors except as expressly authorized by these Terms.

Third Party Accounts

You will be able to connect your Polarity account to third party accounts. By connecting your Polarity account to your third party account, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third party sites). If you do not want information about you to be shared in this manner, do not use this feature.

International Users

The Service is controlled, operated and administered by Polarity from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Polarity Content accessed through polarityair.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Indemnification

You agree to indemnify, defend and hold harmless Polarity, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney’s fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Polarity reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Polarity in asserting any available defenses.

Class Action Waiver

To the extent permitted by law, any claim under these Terms and Conditions will be brought on an individual basis; class and representative actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Polarity agree otherwise, no court may consolidate more than one person’s claims into a single representative or class proceeding.

Liability Disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. Polarity Air AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.

Polarity Air AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED “AS IS” WITHOUT WARRANTY OR CONDITION OF ANY KIND. Polarity Air AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Polarity Air AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF Polarity Air OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.

Termination/Access Restriction

Polarity reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Texas and you hereby consent to the exclusive jurisdiction and venue of courts in Texas in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Polarity as a result of this agreement or use of the Site. Polarity’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Polarity’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Polarity with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Polarity with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Polarity with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

Changes to Terms

Polarity reserves the right, in its sole discretion, to change the Terms under which polarityair.com is offered. The most current version of the Terms will supersede all previous versions. Polarity encourages you to periodically review the Terms to stay informed of our updates.

Credit Authorization Disclosure

By scheduling a booking with Polarity Air, you authorize Polarity, and its financial partners, to access your credit report information for purposes related to providing services, determining estimate and financing options, and verifying your identity, in accordance with the Fair Credit Reporting Act (FCRA).

This authorization may include a soft credit inquiry, which does not impact your credit score.

By scheduling a booking, you acknowledge and consent to this credit authorization.

SMS Messaging Terms

By providing your mobile phone number and opting in to receive text messages from Polarity Air, you agree to receive SMS and/or MMS messages from Polarity Air, including messages sent using automated technology where permitted by law.

Polarity Air’s SMS messaging program may be used to send communications related to our HVAC, heating, cooling, ventilation, electrical, indoor air quality, appointment booking, customer service, and product offerings. Message types may include, but are not limited to:

• Appointment reminders;
• Scheduling confirmations;
• Service updates;
• Technician arrival notifications;
• Maintenance reminders;
• Customer support messages;
• Account or service notifications;
• Estimate, financing, or booking-related communications;
• Promotional offers and marketing messages, where permitted.

Consent to receive SMS messages is not required as a condition of purchasing any goods or services from Polarity Air.

SMS Opt-Out Instructions

You may opt out of receiving SMS messages from Polarity Air at any time by replying STOP to any text message you receive from us.

After you send STOP, we may send one final confirmation message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from Polarity Air unless you opt in again.

Message Frequency, Message and Data Rates

Message frequency may vary depending on your appointments, service requests, account activity, and communication preferences.

Message and data rates may apply to any SMS or MMS messages sent or received, as determined by your mobile carrier and your mobile service plan. You are responsible for any charges imposed by your mobile carrier.

Carrier Liability Disclaimer

Mobile carriers are not liable for delayed or undelivered messages.

SMS and MMS message delivery may be affected by factors outside of Polarity Air’s control, including mobile carrier network availability, device settings, service interruptions, or other technical issues. Polarity Air does not guarantee that SMS or MMS messages will be delivered, received, or read within any specific timeframe.
